Upcoming Changes: AB 352 Cottage Food Expansion

Nevada recently passed Assembly Bill 352 (AB 352), a major update to the state’s cottage food and microenterprise home kitchen laws. This legislation expands what home-based food entrepreneurs like Loaf & Lore can do – while maintaining strong safety and labeling standards.

This page outlines what will change for our customers and operations once AB 352 officially takes effect in 2027.

AB 352 was signed into law in 2025 to support small, home-based food producers across Nevada.

The law updates Nevada’s cottage food framework to reflect modern direct-to-consumer business models – including online sales, delivery options, and expanded product categories.


🔄 What Will Change for Loaf & Lore

🥖 1. Expanded Sales Channels

Under AB 352, Loaf & Lore will be allowed to:

  • Accept online and phone payments for cottage food items (currently prohibited).
  • Offer shipping and local delivery through approved carriers or platforms.
  • Sell through third-party vendors such as markets, events, and select retail partners.

These changes will make it easier for customers across Nevada to enjoy our baked goods, without compromising safety or freshness.


💼 2. Revised Oversight Agency

Oversight of Nevada’s Cottage Food Program will transition from the Department of Public and Behavioral Health (DPBH) to the Department of Agriculture (NDA).

This change streamlines regulations and aligns Nevada’s cottage food system with national standards. Loaf & Lore will update registration and documentation as required under the new department.


📦 3. Shipping & Packaging Standards

Once shipping becomes permitted, all Loaf & Lore packaging will be:

  • Sealed in tamper-evident containers,
  • Labeled with clear storage instructions and best-by dates, and
  • Tested for shelf stability to confirm products remain safe during transit.

We’ll continue to sell only non-potentially hazardous foods and will publish test results for new products that qualify under the expanded law.


🧾 4. Updated Labeling Requirements

When AB 352 takes effect, our labels will include:

  • The same cottage food disclosure statement,
  • A new line for shipping or third-party sale contact info,
  • QR codes linking to ingredient details, batch codes, or allergen data, and
  • Updated registration and compliance numbers under the Department of Agriculture.

Example of updated disclosure (effective 2027):

“This product was prepared in a home kitchen registered with the Nevada Department of Agriculture under the Cottage Food Program and is not subject to routine inspection.”


💬 5. New Ordering & Payment Options

Customers will soon be able to:

  • Prepay online for pickup or shipping via our secure checkout system
  • Schedule pickups directly through our website calendar
  • Receive digital receipts and automated ingredient/allergen breakdowns

These tools will simplify orders while keeping full transparency around food source, preparation, and labeling.

  • Adhere to labeling and allergen disclosure standards
  • Provide batch tracking and traceability for every product

⚖️ Current Legal Status

Until AB 352 takes effect:

  • Loaf & Lore will continue to operate under NRS 446.866 and NAC 446.854,
  • Cottage food items will remain pickup-only,
  • Payments for food products will be accepted in person at pickup, and
  • All operations will stay registered under the DPBH as License ST-090-31580.

When the law becomes active, this page will transition into a live compliance statement with detailed updates for customers and regulators.
